Preview is attaching "quarantine" metadata to every file

Preview has forever been my go to app on Apple. Trusted, versatile, a major component in my workflow.
Now it appears to be potentially handicapped (in Sonoma 14.14.1) because it is **attaching quarantine metadata to every file it opens!** So once a file, from any source (the tests I have done are on images I created), is touched by Preview it becomes potentially unusable, apparently marked as a threat to my system.
I came across this behavior because of a bug in Image Capture's scanner software. Files from the scanner were unable to be saved after opening and making changes in Preview. After more testing this appears to only happen when doing flat scans, black&white image, set to thousands of greys. This initiated the ask, but the question remains the same:
How do I stop Preview from making this mistake? And how do I fix the files it has mislabled?
I have already: used
xattr -r -d com.apple.quarantine
to clear the flag which does not work, it just returns after being cleared.
